The Truth About the Health Care Bill(s) -

Well, I have done it! I have read the entire text of proposed House Bill 3200: The Affordable Health Care Choices Act of 2009. I studied it with particular emphasis from my area of expertise, constitutional law. I was frankly concerned that parts of the proposed law that were being discussed might be unconstitutional.

What I found was far worse than

what I had heard or expected.

To begin with, much of what has been said about the law and its implications is in fact true, despite what the Democrats and the media are saying. The law does provide for rationing of health care, particularly where senior citizens and other classes of citizens are involved, free health care for illegal immigrants, free abortion services, and probably forced participation in abortions by members of the medical profession.

The Bill will also eventually force private insurance companies out of business and put everyone into a government run system. All decisions about personal health care will ultimately be made by federal bureaucrats and most of them will not be health care professionals.

Hospital admissions, payments to physicians, and allocations of necessary medical devices will be strictly controlled.

However, as scary as all of that it, it just scratches the surface. In fact, I have concluded that this legislation really has no intention of providing affordable health care choices. Instead it is a convenient cover for the most massive transfer of power to the Executive Branch of government that has ever occurred, or even been contemplated.

If this law or a similar one is adopted, major portions of the Constitution of the United States will effectively have been destroyed.

The first thing to go will be the masterfully crafted balance of power between the Executive, Legislative, and Judicial branches of the U.S. Government.

The Congress will be transferring to the Obama Administration authority in a number of different areas over the lives of the American people and the businesses they own. The irony is that the Congress doesn't have any authority to legislate in most of those areas to begin with. I defy anyone to read the text of the U.S. Constitution and find any authority granted to the members of Congress to regulate health care.

This legislation also provides for access by the appointees of the Obama administration of all of your personal healthcare information, your personal financial information, and the information of your employer, physician, and hospital. All of this is a direct violation of the specific provisions of the 4th Amendment to the Constitution protecting against unreasonable searches and seizures.

You can also forget about the right to privacy. That will have been legislated into oblivion regardless of what the 3rd and 4th Amendments may provide.If you decide not to have healthcare insurance or if you have private insurance that is not deemed ´acceptable to the Health Choices Administrator appointed by Obama there will be a tax imposed on you. It is called a ´tax instead of a fine because of the intent to avoid application of the due process clause of the 5th Amendment. However, that doesn’t work because since there is nothing in the law that allows you to contest or appeal the imposition of the tax, it is definitely depriving someone of property without the ´due process of law.

So, there are three of those pesky amendments that the far left hate so much out the original ten in the Bill of Rights that are effectively nullified by this law.

It doesn?t stop there though. The 9th Amendment that provides: ´The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people;

The 10th Amendment states: ´The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are preserved to the States respectively, or to the people. Under the provisions of this piece of Congressional handiwork neither the people nor the states are going to have any rights or powers at all in many areas that once were theirs to control.I could write many more pages about this legislation, but I think you get the idea. This is not about health care; it is about seizing power and limiting rights.

Article 6 of the Constitution requires the members of both houses of Congress to ´be bound by oath or affirmation¡ to support the Constitution. If I was a member of Congress I would not be able to vote for this legislation or anything like it without feeling I was violating that sacred oath or affirmation. If I voted for it anyway I would hope the American people would hold me accountable.For those who might doubt the nature of this threat I suggest they consult the source.

MARTIN MAWYER, There's 35 compounds, villages, communities that Sheikh Gilani has inside the United States. They range anywhere from the East coast of New York to South Carolina to the West Coast, Seattle, Washington, and from New York down to Texas.


HANNITY: Knowing the extremism that you're talking about, that he advocates here, and this is not in dispute, correct?


MAWYER: No, it's not in dispute.


HANNITY: Then why would the United States government allow these facilities to stay open?


MAWYER: Well, we spent two and a half years investigating this group, and during that time we interviewed law enforcement about why these groups, why these facilities were allowed to exist in the United States.We got a host of reasons, but the No. 1 reason is they are protected by the U.S. Constitution, and they are protected by state constitutions in the United States. Really, law enforcement's hands are tried in trying to shut these groups down.


HANNITY: I want you to explain to our audience here, because you're describing this particular man, his involvement, you say, in the Daniel Pearl, you know, beheading. How certain are you that every one of those compounds shares the radical views?


MAWYER: We went to seven of these compounds. We had the "Soldiers of Allah" videotape, which your viewers just watched. And we said, "We're going to set out on a mission. We're going to visit the seven compounds we were aware of and ask their leaders to watch this tape, either accept or reject Sheikh Gilani's call to be an Islamic guerilla warfare training camp." None of them rejected the tape.


HANNITY: How is he connected specifically to each and every compound?


MAWYER: Well, each and every compound is owned by a group called Muslims of America. Muslims of America in the United States is their American name for a group based in Pakistan called Jamaat ul-Fuqra.


HANNITY: Which is the one that he is — and these are his words, and this is what his advocacy is. So in other words, let me guess, and you tell me if I'm wrong here. So that when you went to the seven compounds, of the 35, if you were to — if they were to condemn the statements of him, that would mean to them what? For them what?


MAWYER: Well, actually, none of them would condemn them. These people believe Sheikh Gilani is the direct descendant of the Prophet Mohammed, that he speaks for the Prophet Mohammed. They file — follow him with utmost loyalty. They believe basically, he's speaking for the word of Allah. They will not condemn him. They will not criticize him. That's what we learned.As a matter of fact, in one camp in Georgia one of the leaders watched the "Soldiers of Allah" video tape and said what's wrong with Sheikh Gilani setting up paramilitary training camps inside the United States? I encourage your viewers to watch this tape to see what happens.


HANNITY: Do you think — you think Gilani's facilities in the U.S. are planning attacks on American cities and — it's almost unimaginable in a post-9/11 world that that could exist. You're saying you think that they're planning, plotting, scheming the next attack against the Americans?



MAWYER: Not only do I believe that, not only would people who watch this documentary believe that, but even the law enforcement officials that we have spoken with, not the ones based in Washington, D.C., but the field officers, they believe that. We've had law enforcement tell us they have weapons of mass destruction, that they...

HANNITY: What — what kind of weapons of mass destruction?


MAWYER: Well, in some cases I can't even tell you, Sean, because the confidential information that was given to me by these particular law enforcement officials.


HANNITY: You're saying without a doubt you can look in these cameras tonight and tell the American people that there are terrorist training camps on our soil, we're not doing anything about it, and they're planning, and they will hit America?


MAWYER: I would say without a doubt al Qaeda would love to have such compounds that range from 25 acres to 300 acres sitting on American soil in order to hide terrorists, hide weapons, and train future jihadists for the United States. It's shocking.

Listening to a Liar by Thomas Sowell

The most important thing about what anyone says are not the words themselves but the credibility of the person who says them. The words of convicted swindler Bernie Madoff were apparently quite convincing to many people who were regarded as knowledgeable and sophisticated. If you go by words, you can be led into anything. No doubt millions of people will be listening to the words of President Barack Obama Wednesday night when he makes a televised address to a joint session of Congress on his medical care plans. But, if they think that the words he says are what matters, they can be led into something much worse than being swindled out of their money.

One plain fact should outweigh all the words of Barack Obama and all the impressive trappings of the setting in which he says them: He tried to rush Congress into passing a massive government takeover of the nation's medical care before the August recess-- for a program that would not take effect until 2013!

Whatever President Obama is, he is not stupid. If the urgency to pass the medical care legislation was to deal with a problem immediately, then why postpone the date when the legislation goes into effect for years-- more specifically, until the year after the next Presidential election?

If this is such an urgently needed program, why wait for years to put it into effect? And if the public is going to benefit from this, why not let them experience those benefits before the next Presidential election? If it is not urgent that the legislation goes into effect immediately, then why don't we have time to go through the normal process of holding Congressional hearings on the pros and cons, accompanied by public discussions of its innumerable provisions? What sense does it make to "hurry up and wait" on something that is literally a matter of life and death?

If we do not believe that the President is stupid, then what do we believe? The only reasonable alternative seems to be that he wanted to get this massive government takeover of medical care passed into law before the public understood what was in it. Moreover, he wanted to get re-elected in 2012 before the public experienced what its actual consequences would be.

Unfortunately, this way of doing things is all too typical of the way this administration has acted on a wide range of issues. Consider the "stimulus" legislation. Here the administration was successful in rushing a massive spending bill through Congress in just two days-- after which it sat on the President's desk for three days, while he was away on vacation. But, like the medical care legislation, the "stimulus" legislation takes effect slowly. The Congressional Budget Office estimates that it will be September 2010 before even three-quarters of the money will be spent.

Some economists expect that it will not all be spent by the end of 2010. What was the rush to pass it, then? It was not to get that money out into the economy as fast as possible. It was to get that money-- and the power that goes with it-- into the hands of the government.

Power is what politics is all about. The worst thing that could happen, from the standpoint of those seeking more government power over the economy, would be for the economy to begin recovering on its own while months were being spent debating the need for a "stimulus" bill.

As the President's chief of staff, Rahm Emanuel, said, you can't let a crisis "go to waste" when "it's an opportunity to do things you could not do before." There are lots of people in the Obama administration who want to do things that have not been done before-- and to do them before the public realizes what is happening.

The proliferation of White House "czars" in charge of everything from financial issues to media issues is more of the same circumvention of the public and of the Constitution. Czars don't have to be confirmed by the Senate, the way Cabinet members must be, even though czars may wield more power, so you may never know what these people are like, until it is too late. After over six months of hawking nationalized health care, a day of televised interviews broadcast from the White House on a major broadcast network, prime time news conferences, over two dozen speeches around the country and now an address to a joint session of Congress, is it possible that the President actually thinks the American people don’t understand that Democrats want the government to run our health care system? The President said last night he supports the “government option” -- he called it a means to an end -- and that’s something the American people fully understand, but not in the way he intended. That’s part of the President’s problem. He did not overcome his biggest obstacle last night, which is the common sense understanding of the American people. You cannot give better coverage to those who have insurance, put millions people more into the system, pay for it by ending waste and abuse, claim you will lower health care costs, create a government-run exchange, include government health care coverage and not spend a dime -- all at the same time. That’s a fairy tale. If it’s that easy, why not first cut the hundreds of billions of dollars a year in waste, fraud and abuse? Just do it and stop talking about it. You don’t need a bill for that.One of the more outrageous claims made by Obama last night, “If you come to me with a serious set of proposals, I will be there to listen. My door is always open.” (Unnoticed by most of the media, when the President made this absurd remark, several Republican members in the chamber held up the bills they’ve introduced which have been ignored by the White House.)On May 13, House Republican leaders wrote to the President asking for a meeting to, “… respectfully request a meeting with you to discuss areas for potential common ground on health care reform.” Nearly four months later, still no meeting. More change you can believe in.....The Cap and Trade bill passed in the House and now is in the Senate. A lot has been said about the enormous tax hit and energy price hikes to every tax payer that will follow this bill, but not much has been leaked about the impact on your ability to sell and maintain your home. Hah, gotcha. Read on.....

H.R. 2454, the "Cap & Trade" bill was passed by the House of Representatives, if also passed by the Senate, will be the largest tax increase any of us has ever experienced. The Congressional Budget Office (supposedly non-partisan) estimates that in just a few years the average cost to every family of four will be $6,800 per year. No one is excluded. However, once the lower classes feel the pinch in their wallets, you can be sure these voters get a tax refund (even if they pay no taxes at all) to offset this new cost. Thus, you Mr. and Mrs. Middle Class America will have to pay even more since additional tax dollars will be needed to bail out everyone else. But wait.

This awful bill (that no one in Congress has actually read.....this is the one the Dems hired a speed reader to read aloud, has many more surprises in it. Probably the worst one is this: A year from now you may not be able to sell your house. Yes, you read that right. The caveat is (there always is a caveat) that if you have enough money to make required major upgrades to your home, then you can sell it. But, if not, then forget it.

Even pre-fabricated homes (mobile homes) are included. In effect, this bill prevents you from selling your home without the permission of the EPA administrator (Czar). To get this permission, you will have to have the energy efficiency of your home measured. Then the government will tell you what your new energy efficiency requirement is and you will be forced to make modifications to your home under the retrofit provisions of this Act to comply with the new energy and water efficiency requirements. Then you will have to get your home measured again and get a license (called a "label" in the Act) that must be posted on your property to show what your efficiency rating is; sort of like the Energy Star efficiency rating label on your refrigerator or air conditioner.

If you don't get a high enough rating, you can't sell. And, the EPA administrator is authorized to raise the standards every year, even above the automatic energy efficiency increases built into the Act. (ahhh..there was a time when we didn't pay annual license fees on cars...does this sound a bit familiar?)

The EPA Czar, appointed by the President, will run the Cap & Trade program (AKA the "American Clean Energy and Security Act of 2009") and is authorized to make any future changes to the regulations and standards he alone determines to be in the government's best interest. Requirements are set low initially so the bill will pass Congress; then the Administrator can set much tougher new standards every year.

The Act itself contains annual required increases in energy efficiency for private and commercial residences and buildings. However, the EPA administrator can set higher standards at any time.

Sect. 202 Building Retrofit Program mandates a national retrofit program to increase the energy efficiency of all existing homes across America . Beginning 1 year after enactment of the Act, you won't be able to sell your home unless you retrofit it to comply with the energy and water efficiency standards of this Act.

You had better sell soon, because the standards will be raised each year and will be really hard (i.e., ex$pen$ive) to meet in a few years. Oh, goody!

The Act allows the government to give you a grant of several thousand dollars to comply with the retrofit program requirements if you meet certain energy efficiency levels. But, wait, the State can set additional requirements on who qualifies to receive the grants.

You should expect requirements such as "can't have an income of more than $50K per year", "home selling price can't be more than $125K", or anything else to target the upper middle class (and that's YOU) and prevent them from qualifying for the grants.

Most of us won't get a dime and will have to pay the entire cost of the retrofit out of our own pockets.

More transfer of wealth, more "change you can believe in." Sect. 204 Building Energy Performance Labeling Program establishes a labeling program that for each individual residence will identify the achieved energy efficiency performance for "at least 90 percent of the residential market within 5 years after the date of the enactment of this Act."

This means that within 5 years 90% of all residential homes in the U.S. must be measured and labeled. The EPA administrator will get $50M each year to enforce the labeling program. The Secretary of the Department of Energy will get an additional $20M each year to help enforce the labeling program. Some of this money will, of course, be spent on coming up with tougher standards each year. Oh, the label will be like a license for your car. You will be required to post the label in a conspicuous location in your home and will not be allowed to sell your home without having this label. And, just like your car license, you will probably be required to get a new label periodically - maybe every year.

But, the government estimates the cost of measuring the energy efficiency of your home should only cost about $200 each time. Remember what they said about the auto smog inspections when they first started: that in California it would only cost $15. That was when the program started. Now the cost is about $50 for the inspection and certificate; a 333% increase.

Expect the same from the home labeling program. Sect. 304 Greater Energy Efficiency in Building Codes establishes new energy efficiency guidelines for the National Building Code and mandates at 304(d) that 1 year after enactment of this Act, all state and local jurisdictions must adopt the National Building Code energy efficiency provisions or must obtain a certification from the federal government that their state and/or local codes have been brought into full compliance with the National Building Code energy efficiency standards.

THE IDOCY OF MICHAEL MOORE / "CAPITALISM IS EVIL"

VENICE (Reuters) - Capitalism is evil. That is the conclusion U.S. documentary maker Michael Moore comes to in his latest movie "Capitalism: A Love Story," which premieres at the Venice film festival Sunday.
Blending his trademark humor with tragic individual stories, archive footage and publicity stunts, the 55-year-old launches an all out attack on the capitalist system, arguing that it benefits the rich and condemns millions to poverty.
"Capitalism is an evil, and you cannot regulate evil," the two-hour movie concludes.
"You have to eliminate it and replace it with something that is good for all people and that something is democracy."
The bad guys in Moore's mind are big banks and hedge funds which "gambled" investors' money in complex derivatives that few, if any, really understood and which belonged in the casino.
Meanwhile, large companies have been prepared to lay off thousands of staff despite boasting record profits.
The filmmaker also sees an uncomfortably close relationship between banks, politicians and U.S. Treasury officials, meaning that regulation has been changed to favor the few on Wall Street rather than the many on Main Street.
He says that by encouraging Americans to borrow against the value of their homes, businesses created the conditions that led to the crisis, and with it homelessness and unemployment.
Moore even features priests who say capitalism is anti-Christian by failing to protect the poor.
"Essentially we have a law which says gambling is illegal but we've allowed Wall Street to do this and they've played with people's money and taken it into these crazy areas of derivatives," Moore told an audience in Venice.
"They need more than just regulation. We need to structure ourselves differently in order to create finance and money, support for jobs, businesses, etc."
GREEN SHOOTS?
Amid the gloom, Moore detects the beginnings of a popular movement against unbridled capitalism, and believes President Barack Obama's rise to power may bolster it.
"Democracy is not a spectator sport, it's a participatory event," he told a news conference. "If we don't participate in it, it ceases to be a democracy. So Obama will rise or fall based not so much on what he does but on what we do to support him."
Moore also warned other countries around the world against following the recent U.S. economic and political model.
The film follows factory workers who stage a sit-in at a Chicago glass factory when they are sacked with little warning and no pay and who eventually prevail over the bank.
And a group of citizens occupies a home that has been repossessed and boarded up by the lending company, forcing the police who come to evict them to back down.
The film re-visits some of Moore's earlier movies, including a trip to his native Flint where his father was a car assembly line worker and was able to buy a home, a car, educate his children and look forward to a decent pension.
But he brings it up to date with an examination of the financial crisis, demanding to speak to the bosses of companies at the center of the collapse and demanding that banks give back the hundreds of billions of bailout dollars to the country.
And he interviews an employee of a firm which buys up re-possessed, or "distressed" properties at a fraction of their original value and which is called Condo Vultures.

What happened to President Obama? His wax wings having melted, he is the man who fell to earth. What happened to bring his popularity down further than that of any new president in polling history save Gerald Ford (post-Nixon pardon)?

The conventional wisdom is that Obama made a tactical mistake by farming out his agenda to Congress and allowing himself to be pulled left by the doctrinaire liberals of the Democratic congressional leadership. But the idea of Harry Reid and Nancy Pelosi pulling Obama left is quite ridiculous. Where do you think he came from, this friend of Chávista ex-terrorist William Ayers, of PLO apologist Rashid Khalidi, of racialist inciter Jeremiah Wright?
But forget the character witnesses. Just look at Obama's behavior as president, beginning with his first address to Congress. Unbidden, unforced and unpushed by the congressional leadership, Obama gave his most deeply felt vision of America, delivering the boldest social democratic manifesto ever issued by a U.S. president. In American politics, you can't get more left than that speech and still be on the playing field.
In a center-right country, that was problem enough. Obama then compounded it by vastly misreading his mandate. He assumed it was personal. This, after winning by a mere seven points in a year of true economic catastrophe, of an extraordinarily unpopular Republican incumbent, and of a politically weak and unsteady opponent. Nonetheless, Obama imagined that, as Fouad Ajami so brilliantly observed, he had won the kind of banana-republic plebiscite that grants caudillo-like authority to remake everything in one's own image.
Accordingly, Obama unveiled his plans for a grand makeover of the American system, animating that vision by enacting measure after measure that greatly enlarged state power, government spending and national debt. Not surprisingly, these measures engendered powerful popular skepticism that burst into tea-party town-hall resistance.
Obama's reaction to that resistance made things worse. Obama fancies himself tribune of the people, spokesman for the grass roots, harbinger of a new kind of politics from below that would upset the established lobbyist special-interest order of Washington. Yet faced with protests from a real grass-roots movement, his party and his supporters called it a mob -- misinformed, misled, irrational, angry, unhinged, bordering on racist. All this while the administration was cutting backroom deals with every manner of special interest -- from drug companies to auto unions to doctors -- in which favors worth billions were quietly and opaquely exchanged.
"Get out of the way" and "don't do a lot of talking," the great bipartisan scolded opponents whom he blamed for creating the "mess" from which he is merely trying to save us. If only they could see. So with boundless confidence in his own persuasiveness, Obama undertook a summer campaign to enlighten the masses by addressing substantive objections to his reforms.
Things got worse still. With answers so slippery and implausible and, well, fishy, he began jeopardizing the most fundamental asset of any new president -- trust. You can't say that the system is totally broken and in need of radical reconstruction, but nothing will change for you; that Medicare is bankrupting the country, but $500 billion in cuts will have no effect on care; that you will expand coverage while reducing deficits -- and not inspire incredulity and mistrust. When ordinary citizens understand they are being played for fools, they bristle.
After a disastrous summer -- mistaking his mandate, believing his press, centralizing power, governing left, disdaining citizens for (of all things) organizing -- Obama is in trouble.
Let's be clear: This is a fall, not a collapse. He's not been repudiated or even defeated. He will likely regroup and pass some version of health insurance reform that will restore some of his clout and popularity.
But what has occurred -- irreversibly -- is this: He's become ordinary. The spell is broken. The charismatic conjurer of 2008 has shed his magic. He's regressed to the mean, tellingly expressed in poll numbers hovering at 50 percent.
For a man who only recently bred a cult, ordinariness is a great burden, and for his acolytes, a crushing disappointment. Obama has become a politician like others. And like other flailing presidents, he will try to salvage a cherished reform -- and his own standing -- with yet another prime-time speech.
But for the first time since election night in Grant Park, he will appear in the most unfamiliar of guises -- mere mortal, a treacherous transformation to which a man of Obama's supreme self-regard may never adapt.
