North Dakota House Passes HR59 for State Sovereignty

On April 7, 2009, the North Dakota House of Representatives passed House Concurrent Resolution 59 (HR59) “affirming North Dakota’s sovereignty under the 10th Amendment to the and to demand the federal government halt its practice of assuming powers and imposing mandates on the states for purposes not enumerated in the Constitution of the United States.”

A concurrent resolution affirming North Dakota’s sovereignty under the 10th Amendment to the Constitution of the United States and to demand the federal government halt its practice of assuming powers and imposing mandates on the states for purposes not enumerated in the Constitution of the United States.
WHEREAS, the 10th Amendment to the Constitution of the United States reads as follows: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people”; and
WHEREAS, the 10th Amendment defines the total scope of federal power as being that specifically granted by the Constitution of the United States and no more; and
WHEREAS, the scope of power defined by the 10th Amendment means that the federal government was created by the states specifically to be an agent of the states; and
WHEREAS, in 2009 the states are demonstrably treated as agents of the federal government; and
WHEREAS, many powers assumed by the federal government and federal mandates are directly in violation of the 10th Amendment to the Constitution of the United States; and
WHEREAS, the 10th Amendment assures that we, the people of the United States of America and each sovereign state in the Union of States, now have, and have always had, rights the federal government may not usurp; and
WHEREAS, the ruled in New York v. United States, 112 S. Ct. 2408 (1992) that Congress may not simply commandeer the legislative and regulatory processes of the states; and
WHEREAS, a number of proposals from previous administrations and some now pending from the present administration and from Congress may further violate the Constitution of the United States;
NOW, THEREFORE, BE IT RESOLVED BY THE OF NORTH DAKOTA, THE SENATE CONCURRING THEREIN: That the Sixty-first Legislative Assembly affirms this state’s sovereignty under the 10th Amendment to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the Constitution of the United States and demands the federal government halt its practice of assuming powers and imposing mandates upon the states for purposes not enumerated in the Constitution of the United States

There are two main political obstacles to ain this session of Congress.
First, the White House has other priorities despite the whining from the Congressional Hispanic Caucus. If and Rahm Emanuel were all that committed to a new amnesty bill as a top priority, the National Council of La Raza would not be sending out a newsletter alert asking its followers to bombard the White House, Reid and Pelosi with calls and emails demanding action “Ahora!” — which they did yesterday. The fact is, the economy makes any such proposal “DOA” in Congress without a full-court press by the White House — which is not going to happen—and even then it would be a loser.
Second,managed to secure the Republican nomination only after neutralizing the amnesty issue by telling Republicans—“I’ve got the message: border security must come first.” If he now supports an amnesty bill while the border fence is incomplete and border security is still years away, he will be universally chastised as a fraud.
The bottom line? Let’s build the fence, a true double fence like we have in San Diego, increasemanpower to 25,000, and only then have a national debate about what to do with the 20 million illegal aliens already here. A debate without true border security is a farce and a fraud.

WASHINGTON, March 24 (Reuters) - With many U.S. newspapers struggling to survive, a Democratic senator on Tuesday introduced a bill to help them by allowing newspaper companies to restructure as nonprofits with a variety of tax breaks.
"This may not be the optimal choice for some major newspapers or corporate media chains but it should be an option for many newspapers that are struggling to stay afloat," said Senator Benjamin Cardin.
A Cardin spokesman said the bill had yet to attract any co-sponsors, but had sparked plenty of interest within the media, which has seen plunging revenues and many journalist layoffs.
Cardin's Newspaper Revitalization Act would allow newspapers to operate as nonprofits for educational purposes under the U.S. tax code, giving them a similar status to public broadcasting companies.
Under this arrangement, newspapers would still be free to report on all issues, including political campaigns. But they would be prohibited from making political endorsements.
Advertising and subscription revenue would be tax exempt, and contributions to support news coverage or operations could be tax deductible.
Because newspaper profits have been falling in recent years, "no substantial loss of federal revenue" was expected under the legislation, Cardin's office said in a statement.
Cardin's office said his bill was aimed at preserving local and community newspapers, not conglomerates which may also own radio and TV stations. His bill would also let a non-profit buy newspapers owned by a conglomerate.
"We are losing our newspaper industry," Cardin said. "The economy has caused an immediate problem, but the business model for newspapers, based on circulation and advertising revenue, is broken, and that is a real tragedy for communities across the nation and for our democracy.
Newspaper subscriptions and advertising have shrunk dramatically in the past few years as Americans have turned more and more to the Internet or television for information.
In recent months, the Seattle Post-Intelligencer, the Rocky Mountain News, the Baltimore Examiner and the San Francisco Chronicle have ceased daily publication or announced that they may have to stop publishing.
In December the Tribune Company, which owns a number of newspapers including The Baltimore Sun, The Chicago Tribune and The Los Angeles Times filed for bankruptcy protection.
Two newspaper chains, Gannett Co Inc (GCI.N) and Advance Publications, on Monday announced employee furloughs. It will be the second furlough this year at Gannett. (Additional reporting by Chuck Abbott) (Editing by David Storey)

SDMM has for the past three years been begging the sheriffs, County Supervisors, and Mayor Sanders to remove all illegal squatter/migrant camps in the county as they are a breeding ground for underage sex slavery and other criminal activity. Sometimes the camps have been removed when we have identified them to authorities; but many times these public officials just look the other way or make excuses why the law cannot be enforced, often due to pressure from the Mexican Government and illegal alien activists like Enrique Morones and Claudia Smith. Why do these Mexican agents protect known sex traffickers of girls as young as 12 years old? How much money do they get paid to protect the large underage sex trade in San Diego County?
Ponder this.....I found large numbers of articles from various newspapers and news video clips from at least five years back reporting the same kind of news about child sex slaves operating on the United States side of the Mexican border. The Mexican cartels members, human smugglers and illegal alien men use the captive young girls and rule with fear and intimidation.
I am including a story from the New York Times that appeared in 2004: It is a story about illegal alien ( the Times calls them undocumented of course) sex slaves that are brought into the interior of the United States as well as being used in U.S. border towns. Today, the New York Times reported that the Obama administration has reiterated its intention to tackle comprehensive immigration reform this year. Immigration restrictionists have been working under the assumption that President Obama’s promise to reform the dysfunctional U.S. immigration system during his first year in office would be sidelined by the current recession. But the White House made clear yesterday that the President intends to make good on his promise. “He intends to start the debate this year,” affirmed Cecilia Muñoz, deputy assistant to the president and director of intergovernmental affairs in the White House.
THE FEDERAL 'DREAM ACT' - A TOUGH ROAD AHEAD
Lawmakers in Congress recently introduced the Development, Relief and Education for Alien Minors Act ---- DREAM Act for short ----- that would give illegal alien students a chance to legalize their status if they complete two years of college or serve two years in the military.
North County congressional representatives have opposed legislation legalizing people who came into the country illegally. Reps. Darrell Issa, R-Vista, and Duncan D. Hunter, R-El Cajon, said they oppose the measure. Rep. Mary Bono Mack, R-Palm Springs, said through a spokeswoman that she has not taken a position on the bill. Rep. Brian Bilbray, R-Solana Beach, said he also opposes the bill. "I do not believe we should spend one dollar of taxpayer funds to support illegal immigration, which is what the Dream Act wants to do," Bilbray said in a written statement.
The bill was introduced late last month in the Senate and House of Representatives by a bipartisan group of lawmakers, including Sens. Richard Durbin, D-Ill., and Richard Lugar, R-Ind.; and Reps. Howard Berman, D-Van Nuys, and Lincoln Diaz-Balart, R-Fla.
No one knows exactly how many illegal immigrant students there are in North County, or anywhere in the country, because schools don't collect such data. They are required by law to educate students regardless of immigration status. The state Legislative Analysts Office estimates there are about 20,000 immigrant students who receive the lower in-state tuition rates under AB 540. It estimated that most of them, about 18,000, are illegal immigrants. The subsidy costs the state about $117 million, according to the analysis.
Groups on both sides of the immigration debate say the bill is unlikely to be approved this year. Both sides say it will be tough for the bill, which was first introduced in 2001, to clear Congress this year because much of Washington's attention will be on the struggling economy. The bill has repeatedly failed to reach the president's desk as Congress struggles to find an answer to fix what most people agree is a broken immigration system.
Supporters, such as the National Council of La Raza, a Latino organization that supports illegal immigrants, say an estimated 65,000 illegal immigrant students graduate from U.S. high schools each year. Most of the students have a hard time finding work or continuing their education because of their immigration status. Opponents say American students should not have to compete for admissions, classrooms and funding with illegal immigrant students at a time when budgets at public colleges are shrinking.
"Universities are in trouble," said Ira Mehlman, a spokesman for the Federation for American Immigration Reform, a group that opposes the Dream Act. "How can you have legislation that not only takes seats away from American students, but subsidizes illegal immigrant students education?"
Mehlman said the Dream Act is a wide-ranging amnesty bill because it allows people up to 35 years old to legalize their status as long as they attend a school.
Opponents also argue that children who legalize their immigration status through the bill would be able to sponsor other family members ---- who are either here illegally or in Mexico waiting to come ---- once they become adults.
Illegal immigrant students are hopeful for passage due to the Democratic majorities in both houses of Congress. They call themselves "AB 540 students" ---- after the Assembly bill signed into law by then-Gov. Gray Davis allowing them to pay in-state tuition rates, instead of the higher out-of-state tuition fees that students from other states pay.

HAVANA -- A "very healthy, very energetic" Fidel Castro asked visiting Congressional Black Caucus members what Cuba could do to help President Barack Obama improve bilateral relations during his first meeting with U.S. officials since falling ill in 2006.
Caucus leader Rep. Barbara Lee, a Democrat from California, said the ailing former Cuban president talked for nearly two hours with her and two other delegation members on Tuesday in a meeting seen as signaling Cuba's willingness to discuss better relations with the United States.
"We believe it is time to open dialogue and discussion with Cuba," Lee told a news conference in Washington upon the caucus members' return. "Cubans do want dialogue. They do want talks. They do want normal relations."
Lee said the group would present its findings to Speaker Nancy Pelosi, a fellow Democrat from California, and White House and State Department officials.
California Democratic Rep. Laura Richardson, who also met Castro with Illinois Democratic Rep. Bobby Rush, said Castro "looked directly into our eyes" and asked how Cuba could help Obama in his efforts to change the course of U.S. foreign policy.
Richardson said she had the impression that 82-year-old Castro wants to see changes in U.S.-Cuba relations in his lifetime.
